1. Who we are

Vertex Funded LLC (the "firm", "we", "us") is the data controller for personal information processed through our website and platform. We are registered in Dubai, United Arab Emirates, under IFZA Free Zone license. Our registered office is in Dubai Silicon Oasis.

If you are located in the European Union, United Kingdom, or another jurisdiction with a specific data-protection regime, the rights described in this policy apply in addition to, not instead of, your statutory rights.

2. What we collect

2.1 You provide directly

• Account: name, email address, phone number, country of residence, date of birth
• KYC: government-issued ID, proof of address, selfie photograph (only for cumulative payouts above $1,000)
• Payment: billing details, crypto wallet addresses, bank account information used for payouts
• Communications: support messages, email correspondence, survey responses

2.2 We collect automatically

• Device: IP address, browser type, OS, device ID, language preferences
• Usage: pages visited, actions taken, time spent, referral source
• Trading: account balance, trade history, login sessions, platform metrics

3. Why we collect it

We only collect personal data for specific, legitimate purposes:

• To provide the service: creating your account, issuing trading credentials, processing payouts
• To verify your identity: KYC compliance for payouts above $1,000 and AML obligations
• To prevent fraud: detecting multiple-account abuse, chargeback fraud, and rule-breaking
• To communicate: sending service notifications, support replies, and (optionally) marketing emails
• To improve: analyzing aggregate usage to fix bugs and improve product
• To comply with law: responding to legitimate legal requests and regulatory obligations

We do not sell your personal data. We do not use your trading strategies for our own proprietary trading.

4. Who we share with

We share data only with third parties necessary to operate the service, and only the minimum required:

• Liquidity provider: our regulated brokerage partner, which executes funded account trades (shares: account IDs, trade data — not personal identity beyond what's required for trade routing)
• Payment processors: card acquirer, crypto payment gateway, banks for wire transfers (shares: billing info and amount)
• KYC provider: our compliance partner that verifies identity documents (shares: ID, address, selfie during verification — retains per their own policy)
• Cloud infrastructure: data hosting providers with industry-standard encryption at rest and in transit
• Email/SMS service: transactional email and notification delivery providers
• Analytics: privacy-respecting, aggregated analytics. No third-party advertising pixels.
• Authorities: when required by valid legal process in our jurisdiction

All third parties are bound by data-processing agreements and may only use your data for the purpose specified.

5. Cookies & tracking

We use a minimal set of cookies:

• Essential: login sessions, security, CSRF protection. Cannot be disabled.
• Functional: remembering preferences (language, theme). Optional.
• Analytics: aggregated, anonymized usage measurement. Optional.

We do not use third-party advertising cookies. We do not sell cookie data to data brokers. You can manage cookie preferences from your account settings or via your browser.

6. Your rights

Regardless of where you live, you have the following rights over your data:

• Access: request a copy of all personal data we hold about you
• Correction: fix any inaccurate or outdated information
• Deletion: request erasure of your data (subject to legal retention requirements, e.g. AML records)
• Portability: export your data in a machine-readable format
• Restriction: pause processing while disputes are resolved
• Objection: opt out of marketing, analytics, and non-essential processing
• Complaint: lodge a complaint with your local data-protection authority

7. Data retention

We keep data only as long as necessary:

• Active account data: for the duration of your account plus 12 months after closure
• KYC & transaction records: 5 years after last transaction (AML obligation)
• Marketing preferences: until you opt out
• Analytics: aggregated and stripped of identifying information after 14 months

8. Security

We protect your data with encryption in transit (TLS 1.3) and at rest, access controls on a least-privilege basis, regular security audits, and incident response procedures. Despite best practices, no system is perfectly secure; if a breach affecting your data occurs, we will notify you promptly per applicable law.

You are responsible for keeping your account password confidential. We recommend enabling two-factor authentication for every account.

9. International transfers

Because we serve traders globally, your data may be processed in servers located in the UAE, European Union, and other countries. Where data leaves your country of residence, we rely on appropriate safeguards — including standard contractual clauses with our sub-processors and encryption both in transit and at rest.
